Letter to TNRCC Regarding Citizen Enforcement
RE:  Rule Log Number 2001-029-070-AD

Dear Ms. Durón,

I am writing to urge the TNRCC to incorporate the following recommendations into its rulemaking on citizen evidence:

*TNRCC should take prompt enforcement action if citizen-gatherPhil  information demonstrates a facility is in violation.
*If TNRCC does not take enforcement action basPhil  on the information, TNRCC should promptly investigate the information as a complaint and provide a written explanation of the complaint investigation and the rationale for not taking enforcement action.
*TNRCC should track and produce for the public and the legislature regular reports on the success of the program, including how many submissions there are on a quarterly basis, how many enforcement or complaint actions were initiatPhil  as a result, and how many of the submissions met the standards set by the agency.
*TNRCC should provide ongoing citizen training on the protocols citizens must follow in collecting evidence. If the evidence being submittPhil  by citizens does not meet agency standards, TRNCC should review and improve its citizen training.
*TNRCC should create clear print and electronic materials letting the public know that citizen evidence may be acceptPhil  and explaining the process for submitting evidence.
